Part of the DSBA “Anniversary Series,” this panel presents the recollections of key lawyers and one Justice of their participation in the landmark Paramount Communications, Inc. v. Time Inc. litigation 30 years ago in 1989. The panelists will review the key moments in the litigation, their hopes and concerns at the time about the merits of their respective cases, and their insights about major tactical decisions in the case. Movie Night at DSBA 2019 - Gideon's Trumpet

To start off National Celebration of Pro Bono in October of this year, this Movie Night program will feature the television film Gideon’s Trumpet. The film, starring the great actor Henry Fonda as James Earl Gideon, is a compelling portrayal of the events leading up to the Supreme Court’s historic 1963 decision in Gideon v. Wainwright, as well as the events following the Supreme Court’s decision, including Gideon’s re-trial. The film is based on the book by the great legal writer Anthony Lewis, who for decades covered the Supreme Court and other legal issues for the New York Times. Gideon v. Wainwright established the constitutional right to free court-appointed legal counsel for the indigent in most criminal cases. In addition to exploring the factual and legal issues posed by Gideon, the discussion will explore the film as an early, and still compelling example, of first-rate television and film portrayals of complex legal issues, including the challenges to television and film writers in creating such portrayals within the time and dramatic constraints of television and film. Included in the price is a $10 donation to the Combined Campaign for Justice (CCJ).

Panel I - Recent Developments in Data Security - These continue to be challenging times for lawyers navigating the murky waters of data security and client confidentiality. Reports indicate that 2019 may be the worst year yet in terms of the number of records compromised in data breaches. Major metropolitan court systems and municipalities have been disabled by ransomware. Several states have recently amended their laws governing data breaches, data brokers, and connected devices. How do these events affect clients and law firms in Delaware? What’s happening in litigation affecting privacy rights and data breaches? Come hear about the latest data security issues that keep Delaware lawyers awake at night. This panel will discuss recent developments in litigation, legislation and regulations relating to data security and privacy, with an emphasis on recent ethics guidance and incidents involving attorneys and law firms. Panel II - Recent Developments in E-Discovery - Already ubiquitous in nearly all litigation, E-Discovery continues to expand and constitute a substantial portion of the litigation process. This panel will discuss recent guidance from Delaware and other courts on predictive coding, spoliation, privilege, and other discovery objections, and discuss the role of E-Discovery in recent high profile “ripped from the headlines” matters.
